Terms of Service

By using WinForm (winform.live), you agree to these terms. We've kept them as plain as we can. If you don't agree with something, please don't use the service.

1. What WinForm does

WinForm helps a survey creator ("Creator") attach a reward to a Google Form survey, share a campaign link, and randomly select winners from confirmed respondents ("Respondents") once a response goal is met. WinForm itself does not host the survey questions, store survey responses, hold reward funds, or deliver rewards.

2. Roles and responsibilities

WinForm is the platform. We provide the campaign page, the email verification, the random draw mechanism, and the result emails. We are not a party to the relationship between Creator and Respondent.

Creators are responsible for the rewards they offer. Reward delivery is honor-system: the Creator commits to sending the promised reward to winners by the means and within the timeframe stated in their campaign. WinForm does not guarantee reward delivery, hold funds in escrow, or mediate disputes - though we may remove repeat non-deliverers from the platform.

Respondents participate at their own discretion. Entering an email into a campaign is voluntary. Filling out a Google Form is voluntary. Receiving a reward from a Creator is contingent on the Creator following through.

3. Free draw, not a lottery

WinForm campaigns are free for Respondents. There is no purchase or payment required to enter, and the reward is not funded by Respondent contributions. This places campaigns in the "free prize draw" / "sweepstakes" category in most jurisdictions, not in the regulated "lottery" category. Creators must not charge Respondents to enter their campaign or use the platform for paid gambling-style promotions.

4. Acceptable use

You agree not to use WinForm to:

Run any campaign that is unlawful in your jurisdiction.
Charge Respondents an entry fee, or otherwise structure a campaign as a paid lottery.
Collect data via a survey for purposes you don't disclose to Respondents.
Promise rewards you do not have or do not intend to deliver.
Spread misinformation, hate speech, harassment, or content that targets a protected group.
Distribute malware, phishing links, or otherwise abuse Respondents.
Impersonate another person or organisation, or misrepresent your affiliation with one.
Submit fraudulent responses, use automated tools to mass-submit, create multiple email aliases to game a draw, or otherwise undermine the fairness of a campaign.
Scrape, reverse-engineer, or interfere with the platform or its security mechanisms.

We reserve the right to remove campaigns, suspend accounts, or refuse service to anyone violating these rules. We do this at our discretion and don't guarantee notice before action.

5. Account and content

You are responsible for the content you submit (campaign titles, descriptions, reward terms, etc.) and for keeping your magic-link email secure. You retain ownership of your campaign content; you grant us a worldwide, royalty-free license to display and serve that content as needed to operate the service (e.g., showing it on your campaign page, generating Open Graph preview images).

6. Privacy

How we handle your data is described in our Privacy Policy. By using WinForm, you agree to the data practices described there.

7. The random draw

Winner selection uses Node.js's crypto.randomInt with a Fisher-Yates shuffle on the set of confirmed respondents. The algorithm runs server-side at the moment a campaign hits its response goal, or when the Creator manually triggers it. Each confirmed respondent has equal probability of selection. We do not adjust, weight, or override results.

8. Disclaimers

WinForm is provided "as is" without warranties of any kind, express or implied. We don't guarantee that the service will be uninterrupted, error-free, or that any specific outcome will result from running a campaign (number of responses, response quality, etc.).

We are not responsible for: rewards a Creator failed to deliver, content a Creator submitted, conduct of Respondents, the survey questions or responses themselves (those live in Google Forms, not with us), changes to third-party services we depend on (Supabase, Resend, Cloudflare, Vercel, Google), or losses you may incur from any of the above.

9. Limitation of liability

To the maximum extent permitted by law, WinForm and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or other intangibles, arising out of your use of (or inability to use) the service. Our total cumulative liability to you, for any claim arising out of these terms or the service, is limited to the amount you have paid WinForm in the past 12 months - which, as of today, is zero.

10. Indemnification

You agree to indemnify and hold harmless WinForm and its operators from any claim, demand, or damages (including legal fees) arising out of content you submit, your violation of these terms, or your violation of any rights of a third party.

11. Changes to these terms

We may update these terms over time. Material changes will be announced on this page with a revised "Last updated" date, and registered Creators will be notified by email. Continued use of the service after changes means you accept the new terms.

12. Termination

You can stop using WinForm at any time. We can suspend or close any account that violates these terms or that we judge presents undue risk to the platform or its users. On termination, your campaigns will be deactivated and the data deletion timeline in our Privacy Policy applies.

13. Governing law

These terms are governed by the laws of Sri Lanka, where WinForm operates. Any disputes will be resolved in Sri Lankan courts unless a local consumer protection law in your country specifies otherwise.
